People keep trying to convince me Gale’s actions were justified because “it was war.” I basically decided to write a little list of things he did that, under today’s international law, would be considered war crimes and crimes against humanity. I’m not an expert in international law, but these are all things I was able to find by googling the Geneva Convention and the Nuremberg Principles. Anyway, here’s some of the horrible crimes Gale committed and the international laws that label them as war crimes!
Gale Hawthorne, you stand accused of the following atrocities:
- Attempted Mass Murder against the people of District 2, including one charge of Attempted Murder for each civilian inside the training facility. Non-combatants include anyone indentured or otherwise coerced into military servitude by reason of legal mandate by the Capitol or a Commutation of a sentence. This is considered a crime against humanity under Nuremberg Principle VI.
- As soon as the fatalities of your “snare bomb” are finally calculated, you will be charged with one count of murder for each civilian killed using the weapon you designed. Since this “snare bomb” was intended to target civilians and any medics who rushed to their aid, it is a blatant violation of Chapter IV, Article 25 of the Geneva convention, and you will also be charged with a war crime for each medic killed as a result of your weapon. This is considered a war crime under Nuremberg Principle VI.
- In the execution of the assault on the Capitol that culminated in the use of the “snare bomb” of your design, children under the age of 15 were taken to a safe zone and the combatants of District 13 impersonated aid workers, at which point the weapons you designed were deployed, disguised as aid packages. This violates Protocol I, Article 85 of the Geneva Convention which prohibits the perfidious use of recognized symbols of aid. While the direct perpetrator is being tried separately and the head conspirator has been assassinated by your compatriot, Katniss Everdeen (who is currently in custody and awaiting trial herself), your design of this weapon was instrumental in the assault, and you will be charged as a co-conspirator. Nuremberg Principle VII states “Complicity in the commission of a crime against peace, a war crime, or a crime against humanity as set forth in Principle VI is a crime under international law,” and so you will be prosecuted as a war criminal for each crime that was within your knowledge and power to prevent, including the use of the bomb you designed.
I remind you, Mr. Hawthorne, that Nuremberg Principle IV states: “The fact that a person acted pursuant to order of his Government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him.” This means that neither the fact that it was wartime nor the fact that you were under direct orders excuses you from your crimes. May God have mercy on your soul.
This tribunal will reconvene at the earliest possible date for further enumeration of charges, trial, and sentencing.”
